Delara Darabi -- Teenage Artist on Death Row Needs Our Help!
On Saturday, January 27, 2007, Iran’s Supreme Court upheld the death sentence of Delara Darabi for a second time. Delara, who is now 20 years old, faces death by public hanging for a murder that took place when she was 17 years old. According to newspaper and court reports, after murdering a woman related to Delara, Delara’s 19 year old boyfriend, Amir Hossein, convinced Delara to admit responsibility for the murder to protect him from execution. Apparently, both teenagers believed that because Delara was under the age of 18, she could not be sentenced to death. This belief proved to be devastatingly false.
With complete disregard for its obligations under the International Covenant on Civil and Political Rights (ICCPR) and the Convention on the Rights of the Child (CRC) , and despite overwhelming evidence of Delara’s innocence, as well as the teenager’s repeated denials about having had any role in the commission of the crime, a court in the city of Rasht found the girl-child guilty of murder based solely on her initial claim of responsibility and sentenced her to death by hanging. Since that ruling, the Islamic regime has repeatedly demonstrated patent disregard for its promises to the international community and to the rights of Iranian children by upholding Delara’s death sentence.
Until recently, Delara had proven to be a remarkably poised young prisoner with an amazing talent for painting and drawing. She had used her gift to compile a diary of her pain as a child prisoner on death row. From the dark confines of her prison cell, Delara produced an impressive collection of paintings that speak of the horrors of prison, of torture, of beatings, of hopelessness, loneliness, and the loss of a child’s innocence. They are haunting images of injustice and brutality. They are the stories of the innocent women and children of Iran, shackled by the injustices of a brutal regime. They are a teenager’s diary of crimes against humanity committed by the very government that should serve as her protector, but is, instead, her jailer and her executioner.
In retaliation to exposing their horrifying crimes, the officials of the Islamic regime took away the only remaining outlet of Delara’s pain: They confiscated her painting materials. When Delara used coal and whatever else she could find to paint her pain on the walls of her prison, they subjected the young artist -- nicknamed “prisoner of colors” -- to brutal forms of emotional and physical abuse. They banned her from painting altogether, and they prevented her from having any visitors or contacting her lawyer except for twice a month briefly by phone. Their abuse proved too much for young Delara, who, true to her sensitive disposition as an artist, wears her pain woefully close to the surface of her skin.
On January 20, 2007, Delara attempted suicide by cutting her wrists.
Fortunately, her cell-mate noticed the incident and called for help. Delara’s emaciated body was rushed to the hospital, where, by what can only be deemed a miracle, doctors were able to revive her and bring her back to life. As of the date of this letter, Delara remains in critical condition and weighs only 35 kilos. Her family and those close to her case are extremely worried about her health, both physically and emotionally.
The silent screams of innocent girls like Delara must be acknowledged by each and every one of us. We MUST express our outrage, voice our anger, and show our support to those who can not speak for themselves. Anything less would be less than human.

عفو بينالملل -- دلارا دارابي
عفو بينالملل با انتشار اطلاعيهای از همگان خواسته است به حکم اعدام يك دختر نوجوان ١٩ سالهی ايرانی اعتراض کنند و از مقامات مسئول ايرانی بخواهند که اجرای حکم را لغو کنند. عفو بينالملل که بويژه منع استفاده از مجازات اعدام برای کودکان مجرم زير ١٨ سال را بارها به مقامات ايرانی گوشزد کرده است، بار ديگر بر تعهد ايران در اين زمينه اشاره کرده و با توضيح وضعيت "دلارا دارابی"، تلاش دارد زندگی وی را به عنوان يک مجرم نوجوان که در هنگام ارتکاب احتمالی جرم زير ١٨ سال بوده است، نجات دهد.
در پايان اين اعلاميه که متن آن در زير آمده است، از همگان خواسته شده که با ارسال نامه، ای-ميل و فاکس به آيتالله خامنهای و آيتالله شاهرودي، ضمن اشاره به تعهد ايران در مورد منع اعدام مجرمين نوجوان، از ايشان بخواهند که اجرای حکم اعدام دلارا دارابی را متوقف نمايند و نيز توصيههای ,کميته حقوق کودک سازمان ملل متحد, به ايران در ژانويه ٢٠٠٥ را بکار بسته و اعدام مجرمين نوجوان را متوقف سازند. ايران امروز عفو بينالملل با انتشار اطلاعيهای از همگان خواسته است به حکم اعدام يك دختر نوجوان ١٩ سالهی ايرانی اعتراض کنند و از مقامات مسئول ايرانی بخواهند که اجرای حکم را لغو کنند. اين دختر ايرانی "دلارا دارابی" نام دارد كه هنگام ارتکاب احتمالی جرم زير ١٨ سال بوده است.

مجرم نوجوان دلارا دارابي، ١٩ ساله، به خاطر قتلی که در زمان ١٧ سالگی وی رخ داده، در خطر اعدام قرار دارد. وی جرم انتسابی را انکار ميکند. ايران عضو پيمان بينالمللی است که به وضوح استفاده از مجازات اعدام را برای جرايمی که توسط افراد زير ١٨ سال صورت ميگيرد ممنوع ميسازد. بر اساس گزارشهای رسيده از خبرگزاری فارسی زنان ,آفتاب,، دلارا دارابی و مرد ١٩ سالهای بنام اميرحسين به قصد سرقت وارد منزل زنی شدند. گفته ميشود که اميرحسين در حين سرقت زن را به قتل ميرساند. دلارا دارابی ابتدا قتل را به عهده ميگيرد، اما سپس اظهارات خود را پس ميگيرد. بنا به گفته وي، اميرحسين از او خواسته است که برای نجات وي، مسئوليت قتل را بپذيرد زيرا افراد زير ١٨سال اعدام نميشوند. دلارا دارابی توسط دادگاهی در شهر رشت به اعدام محکوم شده است. بر اساس گزارشهای رسيده، حکم وی توسط شورايعالی قضايی تاييد شده است. دلارا بر بيگناهی خويش اصرار داشته و اظهار داشته است که در زمان سرقت تحت تاثير مصرف قرصهای آرامبخش، دچار رخوت بوده است. در حال حاضر، رئيس قوه قضائيه ميتواند دستور توقف اجرای حکم اعدام را صادر نموده و پرونده را برای دادرسی مجدد به دادگاه بفرستد. اميرحسين بر اساس گزارش های رسيده به ١٠ سال زندان برای مشارکت در قتل محکوم شده است.
زمينه اطلاعات ايران به عنوان يکی از دولتهای متعهد به ,ميثاق بينالمللی حقوق مدنی و سياسی, و ,پيماننامه حقوق کودک, تعهد نموده است که افرادی را که در هنگام ارتکاب جرم زير ١٨ سال بودهاند، اعدام نکند. اما از سال ١٩٩٠ تا کنون، ايران حداقل ١٨ مجرم نوجوان را که در هنگام ارتکاب جرم زير ١٨ سال بودهاند، اعدام نموده است. تنها در سال ٢٠٠٥، عليرغم درخواست ,کميته حقوق کودک سازمان ملل متحد, برای توقف فوری اجرای احکام اعدام مجرمين نوجوان، حداقل هشت مجرم نوجوان اعدام شدهاند، از جمله تو نوجوان که در هنگام اعدام زير ١٨ سال بودهاند. آخرين مورد اعدام يک مجرم نوجوان، رستم تاجيک، در روز ١٠ دسامبر ٢٠٠٥ رخ داد که اتفاقا روزی است که سازمان ملل متحد به عنوان ,روز حقوق بشر, اعلام نموده است.
در روز ٩ دسامبر، فيليپ آلستون، ,نماينده ويژه سازمان ملل متحد درباره اعدامهای خودسرانه، صحرايی و بدون محاکمه,، از مقامات ايرانی خواست که حکم اعدام رستم تاجيک را متوقف سازند زيرا " در زمانی که تقريبا هر کشور ديگری در جهان بطور روشن و قاطع اعدام افرادی را در زمان ارتکاب جرم کودک بودهاند، تقبيح کرده است، برخورد ايران بويژه غيرقابلقبول است... اين امر از آن رو بيشتر باعث تعجب است که وظيفهی خودداری از چنين اعدامهايی نه تنها روشن و غيرقابل بحث است، بلکه دولت ايران خود نيز تعهد کرده است که اجرای چنين اعدامهايی را متوقف سازد." در طول چهارسال گذشته، ايران لايحه منع چنين موارد اعدامی را مورد بررسی قرار داده است، اما با اين وجود، در طول دو سال گذشته تعداد مجرمين نوجوانی که اعدام شدهاند افزايش يافته است. از اظهارات اخير يک سخنگوی قوه قضائيه چنين بر ميآيد که قانون جديد در هرحال مجازات اعدام را تنها در مورد برخی از جرايمی که توسط کودکان صورت ميگيرد، لغو ميسازد.

For three years, I have searched for answers within the confines of darkness. I need magnanimity without pity or forgiveness other than that which is granted to me by my God. I know that my story must end with forgiveness, yet let us leave aside for the moment that, for three years, I have struggled for my rights to no avail and I have screamed my innocence to ears that are deaf at best.
I believe that creation is born of strained circumstances: strained humanity, strained finances, strained emotions. After all, one learns to paddle for survival only when fear of drowning has set in. I am no exception to this rule.
I do not know which path you have taken to arrive at my paintings. Frankly, it is not important. For I know that it is LOVE that has led you here: love of life, love of humanity, love of belief. These paintings are proof that, even in the darkest confines of human life, there is at least the sensation of safety. After all, one can not remain a prisoner of hopes and dreams.

دلارا دارابی
|

دلارا دارابی دختر 19 ساله، توسط دادگاهی در شهر رشت به خاطر ارتکاب قتل هنگامی که 17 سال داشت، به مرگ محکوم شد. با وجود انکار او به انجام قتل، حکم در اوایل ژانویه توسط دیوان عالی قضایی بر جا ماند. با جود اینکه طبق گزارشات، وکیلش درخواست تجدید نظر کرده بود.
خبرگزاری فارسی زبان آفتاب گزارش داد که دلارا دارابی و یک پسر 19 ساله به نام امیرحسین، به قصد سرقت وارد خانه ای شدند ولی در جریان سرقت، زنی را که در آن خانه زندگی می کرد به قتل رساندند. دلارا دارابی در ابتدا به انجام قتل اعتراف کرد ولی پس از آن، اعتراف خود را پس گرفت و اعلام کرد که او به درخواست امیرحسین مسئولیت قتل را پذیرفته بوده است. بخاطر اینکه امیرحسین از خطر اعدام رها شود. امیر حسین تصور می کرده است دلارا چون هنگام وقوع قتل کمتر از 18 سال داشته، به همین خاطر به مرگ محکوم نمی شود. دلارا گفته است که او هنگام سرقت تحت تاثیر داروهای مخدر بوده است.
بعنوان یکی از دولت های امضاکننده ی تعهدنامه ی مربوط به حقوق مدنی و سیاسی (ICCPR) و کنوانسیون حقوق کودک (CRC) ، دولت ایران متعهد شده است کسی را که هنگام انجام جرم کمتر از 18 سال داشته باشد اعدام نکند. با این وجود، عفو بین الملل از سال 1990 تا کنون 18 مورد اعدام کودکان مجرم را در ایران ثبت کرده است. تنها در سال 2005، حداقل 8 مورد اعدام کودکان مجرم به ثبت رسیده است.
مسئولان ایرانی چهار سال است که اطلاع داده اند در صدد هستند قانونی را مبنی بر لغو مجازات مرگ برای کسانی که هنگام وقوع جرم سنشان کمتر از 18 سال بوده است، بگذرانند. علیرغم این، در طول 2 سال گذشته تعداد کودکان مجرم که اعدام شده اند افزایش یافته است. اظهار نظرهای اخیر یک سخنگوی قوه قضائیه حاکی از آن است که طبق قانون جدید، در هر حال مجازات مرگ فقط برای جرایم خاصی برچیده می شود و این شامل جرایم قصاص که شاکی خصوصی و نه دولتی دارند نخواهد شد. اکثر اعدام ها در مورد کودکان مجرم در ایران در موارد جرم های قصاص بوده است که فرد بعنوان قاتل محکوم شده است.
کمیته ی حقوق کودک سازمان ملل که بر رعایت کنوانسیون حقوق کودک توسط دولت ها نظارت می کند، در ژانویه 2005 ایران را فراخواند تا مجازات های اعدام افراد مجرم را که هنگام ارتکاب جرم کمتر از 18 سال داشته اند، سریعا متوقف کند و استفاده از مجازات اعدام را در چنین پرونده هایی لغو کند.
نهم دسامبر، فیلیپ آلستون، گزارشگر مخصوص کمیسیون حقوق بشر سازمان ملل در مورد دادگاه های بدون صلاحیت و اعدام های عجولانه و خودسرانه، گفت: "وقتی که واقعا هر کشور دیگری در جهان بطور قاطع و روشن اعدام افراد را به خاطر جرمی که پیش از 18 سالگی مرتکب شده اند، به باد انتقاد می گیرد، این رویکرد دولت ایران بطور مشخصا غیر قابل قبول است... این موجب تعجب بیشتری است چرا که ضرورت پایبندی به خودداری از این نوع اعدام ها نه تنها روشن و غیرقابل بحث است، بلکه دولت ایران خودش اعلام نموده است که این اعدام ها را لغو خواهد کرد."
عفو بین الملل از مسئولان ایرانی می خواهد که از اعدام دلارا دارابی و رضا علی نژاد جلوگیری کنند و گام های سریعی را برای لغو مجازات مرگ برای همه ی کودکان مجرم بردارند. این در تطابق با ضرورت پایبندی ایران بعنوان یکی از دولت های امضاکننده ی تعهدنامه ی بین المللی در مورد حقوق مدنی و سیاسی و همچنین کنوانسیون حقوق کودک است.
